Sub: Resolution adopted by the Legislative Assembly of NCT of Delhi to call the attention of Hon’ble Deputy Chief Minister to abolish National Pension System (NPS) and reinstate the Old Pension System in the interest of lakhs of Government Servants’. राष्ट्रीय पेंशन प्रणाली (एनपीएस) को खत्म करने और लाखों सरकारी कर्मचारियों के हित में पुरानी पेंशन प्रणाली को बहाल करने के लिए माननीय उपमुख्यमंत्री का ध्यान देने के लिए दिल्ली के एनसीटी की विधान सभा द्वारा अपनाई गई संकल्प

Sir,

राष्ट्रीय राजधानी क्षेत्र दिल्ली की विधान सभा ने सर्वसम्मति से 26/11/2018 को आयोजित बैठक में श्री अजय दत्त, माननीय विधान सभा के सदस्य द्वारा निम्नलिखित प्रस्ताव को अपनाया:The Legislative Assembly of the National Capital Territory of Delhi unanimously adopted the following resolution moved by Shri Ajay Dutt, Hon’ble Member of Legislative Assembly in its sitting held on 26/11/2018:

"विधानसभा विधानसभा 26 नवंबर 2018 को अपनी बैठक में हल करती है कि: 2004 में तत्कालीन एनडीए सरकार द्वारा सरकारी कर्मचारियों पर लगाए गए विरोधी कर्मचारी नेशनल पेंशन सिस्टम (एनपीएस) के नकारात्मक परिणामों पर ध्यान देना और UPA-1, UPA-2 और NDA-2 सरकारों द्वारा जारी रखा गया,

“The Legislative Assembly in its sitting on 26 November 2018 resolves that: Taking note of the negative consequences of the anti-employee National Pension System (NPS) that is imposed on the Government Servants by the then NDA Government in 2004 and sustained by the UPA-1, UPA-II and NDA-II Governments,

मुख्यमंत्री अरविंद केजरीवाल ने कहा कि वह OPS (पूरानी पेंशन योजना) को बहाल करने के लिए पश्चिम बंगाल, केरल, आंध्र प्रदेश और कर्नाटक जैसे राज्यों में अपने समकक्षों को भी लिखेंगे। यदि ऐसा होता है, तो यह पूरानी पेंशन योजना को बहाल करने के लिए बीजेपी शासित अन्य राज्यों पर दबाव डालेगा।

आखिर NPS को खत्म कर के OPS (पुराने पेंशन सिस्टम ) को क्यों लागू करवाना चाहते है सभी सरकारी कर्मचारी ???

OPS (ओल्ड पेंशन सिस्टम) क्यों बेहतर है NPS (नए पेंशन सिस्टम) से ...?

प्रमुख दलीलें इस प्रकार है –

Old Pension System अच्छा है और NPS खराब है क्योंकि –

1. एनपीएस निवेश पर आश्वासित रिटर्न या न्यूनतम पेंशन के लिए कर्मचारी को कोई गारंटी नहीं देता है।

The NPS does not give any guarantee to the employee either for assured returns on investments or for minimum pension.

2. एनपीएस पारिवारिक पेंशन या सामाजिक सुरक्षा प्रदान नहीं करता है।

The NPS does not provide for family pension or social security.

3. जब आवश्यक हो तो एनपीएस ऋण सुविधा प्रदान नहीं करता है।

The NPS does not provide for loan facility when in dire need.

4. एनपीएस वार्षिक वृद्धि और डीए में वृद्धि प्रदान नहीं करता है।

The NPS does not provide for annual increments and hike in DA.

5. एनपीएस कर्मचारियों को अपनी चिकित्सकीय आपात स्थिति को पूरा करने के लिए अपने पेंशन फंड से पर्याप्त धन वापस लेने की अनुमति नहीं देता है।

The NPS does not allow the employees to withdraw enough money from their own pension fund to meet their medical emergencies.

6. एनपीएस कर्मचारियों को अस्थिर बाजारों और उन तत्वों के भरोसे पर छोड़ देता है जो बाजारों के उतार चढ़ाव (manipulating) के लिए कुख्यात हैं।

The NPS leaves the employees at the mercy of volatile markets and the forces that have notoriously being manipulating the markets.

7. एनपीएस पेंशन फंड से निकासी पर सख़्त प्रतिबंध लगाता है।

The NPS imposes draconian restrictions on withdrawals from pension fund.

8. एनपीएस बीमा कंपनियों को सेवानिवृत्ति के बाद भी कम से कम दस साल तक वार्षिकी खरीदने के लिए मजबूर करने के लिए कर्मचारियों का शोषण करने की अनुमति देता है।

The NPS allows the insurance companies to exploit employees by way of forcing them to buy annuity for minimum of ten years even after retirement.

9. एनपीएस संविधान में निहित कल्याणकारी राज्य की भावना के विपरीत चलता है ।

The NPS runs contrary to the spirit of welfare state as enshrined in the Constitution.

इस तथ्य को देखते हुए एनसीटी की दिल्ली सरकार जो की Pro-People और कल्याण उन्मुख सरकार है , दृढ़ता से इस पक्ष में है की NPS को खत्म करके, पुरानी पेंशन योजना को लागू किया जाए ताकि सरकारी कर्मचारियों के अधिकारों और सुविधाओं को दुबारा से बहाल किया जा सके।

Given the fact that the pro-people and welfare-oriented Government of NCT of Delhi is strongly in favour of restoring the rights and privileges of its employees by way of replacing the NPS with the time tested old pension scheme.

एनपीएस को तत्काल प्रभाव से खत्म करने के लिए भारत सरकार से आग्रह करता हूं और दिल्ली के एनसीटी सरकार के तहत काम कर रहे सभी सरकारी कर्मचारियों के लिए पुरानी पेंशन योजना को लहू किया जाए।

साथ ही केंद्र सरकार से अनुरोध है की वो सभी केन्द्रीय कर्मचारियो के लिए भी NPS खत्म कर के पूरानी पेंशन योजना को लागू करें और सभी राज्य सरकारों को भी पूरानी पेंशन योजना को लागू करने के लिए प्रोत्साहित करें। 

Resolves to urge upon the Government of India to scrap the NPS with immediate effect and bring at once all the Government Servants working under the Government of NCT of Delhi under the old pension scheme and restore to them all the benefits of the old pension scheme wherein the fair and legislative pensions benefits are disbursed through the Consolidated Fund of India, so that the dedicated work force of the Government of NCT of Delhi and their families will be able to lead their lives with sense of security and dignity, and further resolves to urge upon the Government of India to restore the old pension scheme in place of NPS or the benefit of all the Government Servants working under the Government of India and also to activity encourage other States to follow this true welfare measure.”
